[#21] 일반음식점 무신고영업 무죄 사례

법무법인 신재입니다.
본 법무법인 소속변호사가 국선변호활동을 하면서 최근 받아낸 무죄확정 판결입니다.
형사사건에서 무죄를 받기는 쉽지 않아 소개해드립니다.
법률상 식품이란 의약으로 섭취하는 것을 제외한 모든 음식물이라고 정의하고 있습니다.
음식물의 조리, 판매 또는 그 외의 서비스를 제공을 업종을 식품접객업이라고 하고,
그 중 음식류를 조리, 판매하고 부수적으로 음주행위가 허용되는 영업을 음반음식점영업이라고 합니다.
식품접객업 영업을 하려는 사람은 영업허가를 받거나 또는 영업신고하여야 하고,
일반음식점영업은 후자에 해당합니다.
전통시장 중에는 지방자치단체가 개설하여 관리하는 시장있는데 이를 공설시장이라고 하고,
각 지방자치단체에서는 공설시장의 관리 운영을 위해 조례를 제정하고 있으며,
조례에는 임대차계약과 같이 점포 사용(허가)기간 두고 있고, 사용허가취소 사유를 규정하고 있습니다.
사전 설명이 길었네요.
이번 사건은 지방자치단체가 피고인에게 기간을 정하여 공설시장 점포를 사용허가 하였고,
피고인의 그곳에서의 일반음식점영업신고를 하자
지방자치단체는 영업신고증을 발부하면서 점포사용기간에 맞추어 영업기간을 못박아 버렸습니다.
점포사용기간이 종료된 후 구청이 폐업처리를 하였고 그후에도 피고인이 계속해서
영업을 했다가, 무신고 영업으로 기소된 사안이었습니다.
이에 본 법무법인 소속변호사는 영업신고는 신고 그 자체로 피고인이 의무를 다한 것이고,
구청에서 공설시장의 점포사용허가기간을 근거로 영업기간을 제한한 것은 무효라고 변론하였고,
법원이 이를 받아 들인 것입니다.
